1. About These Terms

These Terms of Use govern your access to mie.ngo and related online services operated by Music In Everything Corporation (“MIE,” “we,” “us,” or “our”), a New Jersey nonprofit corporation recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code. Our mailing address is 226 State St Unit 1166, Hackensack, NJ 07602. By using the website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website.

2. Our Mission and Information

MIE provides charitable, educational, cultural, and community programming and information. Website content is provided for general informational purposes and is not legal, tax, financial, medical, or professional advice. Program descriptions, schedules, eligibility, availability, speakers, locations, and fees may change.

3. Eligibility and Youth Participation

You must be able to form a binding agreement to use transaction or account features. Children under 13 may not submit personal information through the website. A parent or legal guardian must submit and consent to information needed for a child’s participation. Additional program releases, consent forms, safety rules, or terms may apply.

4. Donations

Donations support MIE’s charitable mission. Unless a campaign expressly states otherwise, MIE may use gifts where most needed, consistent with applicable law and donor restrictions we accept in writing. Donations are generally nonrefundable. If you believe a donation was made in error, duplicated, or unauthorized, contact support@mie.ngo promptly; refund requests are reviewed individually and remain subject to processor rules and applicable law.

If you authorize a recurring donation, it will continue at the amount and frequency selected until canceled. You may cancel through the payment provider or by contacting us, but cancellation may not reverse a payment already processed. Payment providers, including PayPal, process payment information under their own terms and privacy policies. MIE does not receive full payment-card credentials.

MIE is recognized as tax-exempt under Section 501(c)(3). Contributions may be tax-deductible to the extent permitted by law. No deduction is available for the fair market value of goods or services received. Donation acknowledgments are not tax advice; consult your tax adviser.

5. Purchases, Events, and Programs

Purchases, registrations, memberships, tickets, and paid programs may be subject to additional descriptions and policies shown at checkout, including our Refund Policy. Prices, availability, fulfillment estimates, and event details may change. We may cancel or reschedule an event or program and will explain available remedies. You are responsible for accurate order and contact information and for all charges you authorize.

6. Acceptable Use

You may not use the website to violate law; infringe intellectual-property or privacy rights; submit false, harmful, discriminatory, defamatory, or unlawful material; impersonate another person; interfere with security or operation; introduce malware; scrape or access the website through unauthorized automated means; or misuse donation, registration, account, or communication features. We may restrict access or remove content when reasonably necessary to protect MIE, its community, or the service.

7. Intellectual Property

Unless otherwise stated, the website, MIE name and logos, text, graphics, photographs, audio, video, designs, and other content are owned by or licensed to MIE and protected by applicable law. You may view and share links for personal, noncommercial purposes. No other reproduction, modification, distribution, public display, commercial use, or use of MIE marks is permitted without written authorization. Rights in third-party materials remain with their owners.

8. Submissions and Communications

When you send us feedback, stories, photographs, media, or other content, you represent that you have the right to do so. Unless separate written terms apply, you grant MIE a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, and display that content only for the purpose for which it was submitted and to operate, document, and promote MIE’s mission. Contact us before submitting sensitive or confidential information. You may unsubscribe from marketing emails at any time; transactional and program-related messages may still be sent when necessary.

9. Third-Party Services and Links

The website may connect to Squarespace, PayPal, Mailchimp, social networks, retailers, and other independent services. Their terms and privacy practices govern your use of their services. Links do not imply endorsement, and MIE is not responsible for third-party content, availability, security, or practices.

10. Accessibility and Copyright Concerns

We aim to make our website accessible. To report an accessibility barrier or a good-faith copyright concern, contact support@mie.ngo and include enough information for us to investigate.

11. Disclaimers

To the fullest extent permitted by law, the website and its content are provided “as is” and “as available.” MIE disclaims warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, and uninterrupted or error-free operation. Some jurisdictions do not allow certain exclusions, so these exclusions may not apply to you.

12. Limitation of Liability

To the fullest extent permitted by law, MIE and its directors, officers, employees, volunteers, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, revenue, or opportunity arising from the website. MIE’s total liability for any claim relating to the website will not exceed the amount you paid MIE through the website during the 12 months before the claim, or $100 if no payment was made. These limits do not exclude liability that cannot lawfully be limited.

13. Indemnification

To the extent permitted by law, you agree to indemnify MIE and its personnel from third-party claims, losses, or expenses arising from your unlawful use of the website, your violation of these Terms, or content you submit. This section does not apply to the extent prohibited by law.

14. Suspension and Termination

We may suspend or terminate access when we reasonably believe these Terms were violated or access creates risk to MIE, participants, donors, or others. Provisions that by their nature should survive will remain effective.

15. Governing Law and Disputes

New Jersey law governs these Terms, without regard to conflict-of-law rules. Before filing a claim, please contact support@mie.ngo so we can try to resolve it informally. Unless applicable law requires otherwise, claims must be brought in a state or federal court with jurisdiction in New Jersey. Nothing here limits rights that cannot be waived under applicable consumer law.

16. Changes; Severability; Entire Agreement

We may update these Terms by posting a revised effective date. Material changes will be communicated when required by law. If a provision is unenforceable, the remaining provisions remain effective. These Terms, the Privacy Policy, Refund Policy, and any additional terms presented for a transaction or program are the entire agreement concerning the website. A failure to enforce a provision is not a waiver.
